1. Acceptance of Terms

By accessing or using Namoza (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is operated by Namoza with its principal place of business in India.

2. Description of Service

Namoza is a healthcare marketing platform that enables doctors, clinics, and healthcare professionals to create branded social media content including WhatsApp Status images, Instagram posts, and promotional materials. The Service provides:

  • Pre-designed templates organized by medical specialty
  • Text and color editing capabilities
  • Image generation and download in multiple formats
  • Stock photo integration for template backgrounds

3. User Accounts

To use the Service, you must create an account using Google OAuth sign-in. You are responsible for maintaining the security of your account and for all activities under your account. You must be at least 18 years old and a registered medical professional or authorized representative of a healthcare facility to use the Service.

4. Intellectual Property

Our Content: All templates, designs, icons, layouts, and the Service itself are the intellectual property of Namoza. You may not copy, modify, or distribute our templates or designs except as generated through the Service.

Your Content: You retain ownership of the text, logos, and images you upload. By using the Service, you grant us a limited license to process your content for the purpose of generating marketing materials.

Generated Images: Images generated through the Service are licensed to you for personal and commercial marketing use related to your healthcare practice. You may share these on social media, WhatsApp, and other marketing channels. You may not resell generated images or use them for purposes unrelated to healthcare marketing.

5. Subscription Plans and Payment

The Service offers free and paid subscription plans. Paid plans are billed monthly through Razorpay payment gateway. Prices are in Indian Rupees (INR) and include applicable GST.

  • Free Plan: Limited to 3 image downloads per month with watermarked outputs.
  • Paid Plans: Include higher download limits and watermark-free outputs as specified in the plan details.
  • Credits do not carry over between billing periods unless otherwise stated.
  • We reserve the right to modify pricing with 30 days prior notice.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of medical advertising regulations.
  • Upload content that is misleading, defamatory, or violates any third-party rights.
  • Make false medical claims in generated marketing materials.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated systems or bots to access the Service.
  • Share your account credentials with others or allow multiple users on a single account.

7. Medical Advertising Compliance

You are solely responsible for ensuring that all content generated through the Service complies with applicable medical advertising regulations, including but not limited to the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, and any state-specific medical advertising guidelines. Namoza does not review generated content for regulatory compliance.

8. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period.
  • No partial refunds are provided for unused portions of the billing period.
  • Your account will revert to the Free plan after the paid period ends.
  • Previously generated images remain accessible in your account.

9. Limitation of Liability

To the maximum extent permitted by law, Namoza shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the preceding 12 months.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted access, error-free operation, or that the Service will meet your specific requirements.

11. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, India. Before initiating legal proceedings, both parties agree to attempt resolution through mutual discussion within 30 days of raising the dispute.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Service at least 15 days before they take effect. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
